AN ACT


To amend 7 PNC '604, as amended by RPPL No. 8-17, to delete the requirement that the Ship Registry Administrator be an employee of the Ministry; and for other related purposes.


THE PEOPLE OF PALAU REPRESENTED IN THE OLBIIL ERA KELULAU DO ENACT AS FOLLOWS:


Section 1. Amendment. Section 604 of Title 7 of the Palau National Code, as amended by RPPL No. 8-17, is hereby amended as follows:


ASection 604. Appointment of Ship Registry Administrator; Duties of Administrator.

With the approval of the President, the Minister may appoint a Ship Registry Administrator. Subject to the provisions of this Title, the Minister, with the approval of the President, may, by a written instrument, generally or specifically delegate all or a portion of his authority, power, and functions under this Title to the Administrator or to a Special Agent appointed pursuant to Section 605 of this Title. The President shall have the authority to delegate, through contract, to the Administrator, or its Special Agent appointed pursuant to Section 605, the responsibility of paying all or some of the fees and necessary costs of the Registry, including but not limited to, the Republic=s membership fees for international organizations or treaties associated with the implementation of this Act.@


Section 2. Amendment. Section 9 of RPPL No. 8-18 is hereby amended to state as follows:


ASection 9. Other Agencies and Activities. The sum of $1,721,000 is authorized for appropriation and a sum of $1,721,000 is hereby appropriated for expenditure for Fiscal Year 2011...

(8) PNOC & Sports Organizations $365,000 $365.000

The $200,000 supplemental authorization and appropriation to PNOC & Sports Organizations is to ensure funding is available for the Pacific Games, which are to take place in New Caledonia. The authorized $200,000 supplemental appropriation shall be appropriated from the local revenues for the adjusted Fiscal Year budget of 2011.

Section 3. Amendment. Where, pursuant to the amendment in Section 2, the total amount of the budget appropriated for Fiscal Year 2011 is changed in RPPL 8-18, all references to the total budget shall be amended accordingly pursuant to the amendment set forth in Section 2 of this Act.


Section 4. Foreign Fishing Revenue Distribution. For Fiscal Year 2011 only, all revenues derived from the sale of fishing rights, including but not limited to those revenues obtained in accordance with the Palau Arrangement for the Management of the Western Pacific Fishery as Amended - Management Scheme, or from the licensing of foreign fishing vessels to fish within the Republic of Palau=s jurisdictional waters, shall hereby be divided between the national government and the state governments as follows: 15% of the revenue shall be allocated to the national government, and the remaining 85% of the revenue shall be divided equally amongst all the states of the Republic.


Section 5. Effective Date. This Act will take effect upon its approval by the President or upon its becoming law without such approval, except as otherwise provided by law.
