AN ACT


To authorize and appropriate $500,000.00 from the proceeds of the remaining balance of the Mega Bank Loan for the purpose of funding the 2010 Micronesian Games, to authorize and appropriate $135,419.00 to the Ministry of Health for the purpose of hiring nurses, and for other related purposes.


THE PEOPLE OF PALAU REPRESENTED IN THE OLBIIL ERA KELULAU DO ENACT AS FOLLOWS:


Section 1. Legislative findings. The Olbiil Era Kelulau finds that funds must be appropriated in order for the Republic of Palau to fulfill its hosting obligations for the 2010 Micronesian Games. In approving this appropriation, the Olbiil Era Kelulau urges the President, before expending these funds, to seek funding for the Micronesian Games from the economic stimulus funds granted by the Republic of China, using his authority to reprogram up to 20 percent of the amounts granted. The Olbiil Era Kelulau finds this is still possible because the fund earmarked and obligated for fiscal year 2009 are not yet distributed and will not be expended until late 2010. Any remaining funds reprogrammed for the 2010 Micronesian Games may then be reinstated in fiscal year 2010 for committed projects.


Section 2. Amendment. Section 15 of RPPL No. 8-8 is hereby amended to read as follows:


"Section 15. 2010 Micro Games. The sum of $500,000 is authorized to be appropriated and is hereby appropriated for Fiscal Year 2010 for costs associated with the 2010 Micronesian Games. The source of this appropriation shall be the proceeds of the remaining balance of the Mega Bank Loan. Use of this fund shall be exempt from the procurement requirements of Chapter 6 of Title 40 of the Palau National Code. The Palau National Olympic Committee and the Micro Games Organizing Committee, however, are encouraged to use competitive bidding and best purchasing practices to best utilize this fund. The Palau National Olympic Committee and the Micronesian Game Organizing Committee shall submit quarterly financial reports to the Minister of Finance, Public Auditor, and the Chairmen of the Ways and Means and Financial Matters Committees of the Senate and House of Delegates for the use of this fund and all other funding sources used to fund the Micro Games 2010. Such reports shall include income statements and expenditure reports consistent with generally accepted reporting format. Receipts, invoices, contracts, all other payables and receivables shall be maintained for auditing purposes. The Palau National Organizing Committee and the Micro Game Organizing Committee shall be solely responsible for all expenditures beyond what is authorized and appropriated in this Act."


Section 3. Additional Funding for the Ministry of Health. The sum of $135,419.00 is authorized to be appropriated and is hereby appropriated for Fiscal Year 2010 to the Ministry of Health. The source of this appropriation shall be the proceeds of the remaining balance of the Mega Bank Loan. This entire amount shall be appropriated to the Ministry of Health and earmarked for the sole purpose of hiring nurses.


[sic] Section 3. Effective date. This Act shall take effect upon its approval by the President, or upon becoming law without such approval, except as otherwise provided by law.
