An Act to amend the Gaming Act 1967

(28 July 1989

BE IN ENACTED by the Parliament of the Cook Islands in Session assembled as follows –

  1. Short Title

This Act may be cited as the Gaming Amendment Act 1989 and shall be read together with and deemed part of the Gaming Act 1967 (hereinafter referred to as "the principal Act").

  1. Power to exempt

The principal Act is amended by inserting after section 25, the following new section –

"25A Power to exempt
(1) The Minister may from time to time in his discretion on the application of any person or body of persons (whether incorporated or not) exempt that person or body of persons as the case may be from any of the provisions of this Act and such exemption shall take effect according to its tenor notwithstanding the provisions of any enactment or any rule of law to the contrary.
(2) In granting any exemption under sub-section (1) the Minister may impose such conditions and restrictions as he thinks fit.
(3) In dealing with an application under this section, the Minister shall not be required to act judicially and his decision shall be final.
(4) The Minister may at any time vary, suspend, or revoke any exemption granted under sub-section (1) but shall first give notice of the intention to the person or body of persons as the case may be to whom the exemption was granted and shall give a reasonable opportunity for the cause to be shown as to why the exemption should not be so varied, suspended, or revoked.
(5) The Minister may from time to time appoint an Inspector or Inspectors who shall be responsible to the Minister for supervising and enforcing the conditions and restrictions upon which any exemption granted pursuant to this section may have been granted, and such other duties and responsibilities as may be prescribed."

This Act is administered by the Police.
