A DECREE TO AMEND THE ADMINISTRATION OF JUSTICE DECREE 2009

IN exercise of the powers conferred upon me as President and Commander in Chief of the Republic of the Fiji Military Forces, I hereby make the following Decree:

Short Title

1. This Decree may be cited as the Administration of Justice (Amendment) (No. 2) Decree 2009.

New section added

2. The Administration of Justice Decree 2009 (No. 9 of 2009) is amended by adding the following new section—

"Certificate of Chief Registrar or Tribunal conclusive

23A.—(1) A certificate issued by the Chief Registrar or a Tribunal under section 5(5) or section 23(3) or (5) is, for the purposes of any proceedings in a Court or Tribunal, conclusive of the matters stated in the certificate.

(2) A decision of the Chief Registrar or a Tribunal to issue a certificate under section 5(5) or section 23(3) or (5) is not subject to challenge in any Court or Tribunal."

Retrospective application

3. The amendment affected by section 2 has effect as from the commencement of the Administration of Justice Decree 2009.
