FIJI INDEPENDENT COMMISSION AGAINST CORRUPTION (AMENDMENT) PROMULGATION 2008
(PROMULGATION NO. 2 OF 2009)

IN EXERCISE of the powers conferred upon the Interim Government, and upon the exercise of my own deliberate judgment as President of the Republic of the Fiji Islands as to what is best and good for the people of Fiji, and by the executive authority of the State in accordance with section 85 of the Constitution and such other powers as may appertain, and with the advice of Cabinet, I, Josefa Iloilovatu Uluivuda make this Promulgation -

TO AMEND THE FIJI INDEPENDENT COMMISSION AGAINST CORRUPTION PROMULGATION 2007

Short title

1. This Promulgation may be cited as the Fiji Independent Commission Against Corruption (Amendment) Promulgation 2008.

Section 2A amended

2. Section 2A of the Fiji Independent Commission Against Corruption Promulgation 2007 (the "principal Promulgation") is amended by adding immediately after paragraph (d).

"(da) the offence of misconduct in public office;".

Application of principal Promulgation to amendment

3. For the avoidance of doubt, sections 12A and 12B of the principal Promulgation, which empower the Commission of the Fiji Independent Commission Against Corruption to investigate and prosecute in his own name the offences specified in section 2A of the principal Promulgation, apply to the offence of misconduct in public office (as added by section 2 of this Promulgation) regardless of when the offence was committed, that is to say, to an offence that was committed before the commencement of this Promulgation as well as to an offence committed after that commencement.
