FIJI ISLANDS VISITORS BUREAU (AMENDMENT) PROMULGATION 2009
(PROMULGATION No. 5 OF 2009)

IN EXERCISE of the powers conferred upon the Interim Government, and upon the exercise of my own deliberate judgment as President of the Republic of the Fiji Islands as to what is best and good for the people of the Republic of the Fiji Islands, and by the exercise of the executive authority of the State in accordance with section 85 of the Constitution and such other powers as may appertain, I, Josefa Iloilovatu Uluivuda make this Promulgation-

TO AMEND THE FIJI ISLANDS VISITORS BUREAU ACT [2004]
TO PROVIDE FOR THE RENAMING OF THE FIJI ISLANDS VISITORS BUREAU AS TOURISM FIJI

Short title and commencement

1.-(1) This Promulgation may be cited as the Fiji Islands Visitors Bureau (Amendment) Promulgation
2009.

(2) This Promulgation comes into force on the day it is published in the Gazette.

Section 1 of the Fiji Visitors Bureau Act [2004] amended

2. Section 1 of the Fiji Visitors Bureau Act [2004] (in this Promulgation referred to as "the Act") is amended by repealing "Fiji Islands Visitors Bureau Act [2004]" and substituting "Tourism Fiji Act".

Section 2 amended

3. Section 2 of the Act is amended -

(a) by adding-

""amendment Promulgation of 2009" means the Fiji Islands Visitors Bureau (Amendment) Promulgation (No. ) of 2009;";

(b) by deleting the definition "Bureau" and substituting-

""corporation" means the body corporate mentioned in section 3(1) and known as Tourism Fiji;";

(c) by repealing "the Bureau" and substituting "the corporation" where it twice appears.

Part heading amended

4. The heading to Part 2 is amended by repealing "Fiji Islands Visitors Bureau" and substituting "Tourism Fiji".

Section 3 amended

5. Section 3(1) of the Act is amended -

(a) in subsection (1), by repealing "this Act, as the Fiji Islands Visitors Bureau" and substituting "the amendment Promulgation of 2009, as Tourism Fiji";

(b) in subsection (2), by repealing "The Bureau" and substituting "The corporation"; and

(c) by repealing subsection (3) and substituting -

"(3) The corporate identity and the rights and obligations of the body corporate mentioned in section 3(1) are not affected by any change of its name as provided for in that subsection.".

Sections 4 to 17 amended

6. Sections 4 to 17 of the Act are amended -

(a) by repealing "the Bureau" and substituting "the corporation" wherever it appears;

(b) by repealing "the Bureau's" and substituting "the corporation's" wherever it appears.

Section 20 amended

7. Section 20 of the Act is amended -

(a) in subsection (2) by revolting and substituting with the following -

"(2) At the commencement of this Act, any property, rights, obligations or liabilities which was vested in or belonged to the Fiji Islands Visitors Bureau vest in and belong to Tourism Fiji without conveyance, transfer or assignment and are to be held by Tourism Fiji for the same purpose as they were held by the Fiji Islands Visitors Bureau at the commencement of the Act."

(b) by adding-

"(5) As from the commencement of the amendment Promulgation of 2009, any reference to the Fiji Islands Visitors Bureau in any law or other document, other than this Act, is, in respect of the period beginning with that commencement, to be read as a reference to Tourism Fiji."."

BACKGROUND

The Acting Minister for Tourism, Industry and Trade presents the amendment to the Fiji Islands Visitors Bureau Act 2004.

PURPOSE

The purpose of this Promulgation is to amend the Fiji Island Visitors Bureau Act (2004) to provide for the renaming of the Fiji Islands Visitors Bureau as Tourism Fiji.
