INCOME TAX ACT (BUDGET AMENDMENT) PROMULGATION
(PROMULGATION NO. 19 OF 2007)


IN exercise of the powers conferred upon the Interim Government, and upon the exercise of my own deliberate judgment as President of the Republic of Fiji Islands as to what is best and good for the people of the Republic of the Fiji Islands, and by the exercise of the executive authority of the State in accordance with section 85 of the Constitution and such other powers as may appertain, and with the approval of Cabinet, I, Josefa Iloilovatu Uluivuda, make this Promulgation–


TO AMEND THE INCOME TAX ACT


Short title and commencement


1.-(1) This promulgation may be cited as the Income Tax Act (Budget Amendment) Promulgation 2007, and is deemed to have come into force on 1st January 2007.


Incomes not taxable


2. Section 17 of the Income Tax Act is amended-


(a) in paragraph (55), by inserting “excluding the Colonial First State Income Fund or the Colonial First State Income and Growth Fund or the Fijian Holdings Property Trust Fund" after "South Pacific Stock Exchange”;


(b) by repealing paragraph (63) and substituting the following paragraph -


“(63) the income of an Information Communication Technology operator operating in the declared Kalabu Tax Free Zone from 1 January 2007 to 31 December 2016 provided that the business employs 50 employees or more for any 6 months within the income year and 60 percent of its total services is exported;”; and


(c) by repealing paragraphs (65) and (66).


3. Section 21B of the Income Tax Act is amended by deleting the table in subsection (2) and substituting the following table –

4. The sub-heading of Section 78A of the Income Tax Act is amended by inserting “, hotel turnover tax, gambling turnover tax” after “income tax”.
