Revocation of Judicial Appointments Decree 2009

REVOCATION OF JUDICIAL APPOINTMENTS DECREE 2009

GOVERNMENT OF FIJI
(DECREE NO. 4)


IN exercise of the powers vested in me as the President and Commander in Chief of the Republic of the Fiji Military Forces, I hereby make the following Decree:


1. This Decree may be cited as the Revocation of Judicial Appointments Decree 2009.


2.-(1) Any court of law, authority or office which was established, any appointment which was made and any other thing whatsoever which was done before this 10th day of April 2009 pursuant to any provision of the Constitution Amendment Act 1997 shall be dissolved and all appointments made shall be removed and declared vacant pending the appointment by the President.


(2) The courts of law, authority or office and appointments to which this section applies are the Supreme Court of Fiji, the Court of Appeal, the High Court, and the Magistrates Court, and shall include the following appointments:


(a) Chief Justice


(b) Justices of Appeal


(c) Puisne Judges (including all divisions of the High Court)


(d) Master of the High Court


(e) Chief Magistrate


(f) Magistrates


3. All offices and office holders referred to in section 2 of this Decree whose appointment was the subject of removal or termination or dismissal by this Decree or an instrument given pursuant or upon this Decree, shall not be entitled to any monetary compensation for loss of office or expectation or advantages or benefits as arising therefrom. Nor shall such office holder be entitled to bring any suit, action, or proceedings for damages for unlawful and/or unjust dismissal for loss of office in any court; nor any action, suit, or proceedings for any related relief be it in the nature of judicial review or otherwise.
