Marine (Survey Fees) Regulations, 1990


IN exercise of the powers conferred upon me by sections 94(1) and 212 of the Marine Act, 1986, I have made the following Regulations -


Short title


1. These regulations may be cited as the Marine (Survey Fees) Regulations, 1990.


Purpose


2. These regulations specify the fees to be paid in respect of marine surveying services provided by the Marine Department.


Survey fees


3. -(1) The fees charged for a surveying service specified in Schedule 1 shall be calculated according to the number of hours a surveyor is employed in undertaking the service.


(2) For each surveying service specified in Schedule 1 a minimum number of hours, as shown in that Schedule, will be charged for, and must be paid for, before the service is undertaken.


(3) If a surveyor is employed in undertaking a service specified in Schedule 1 for more than the minimum number of hours shown in that Schedule an additional charge for each additional half hour (or part of a half hour) during which he is so employed will be charged, and must be paid before any certificate or other document can be issued as a result of the survey.


Surveyor’s hourly rate


4. -(1) Subject to subregulation (2),the charge for each half hour that a surveyor is employed in undertaking a service specified in Schedule 1 or in travelling in connection with a service specified in a Schedule to these regulations is -


(a) $15 in the case of -


(a) a registered vessel or a vessel that could be registered; or


(b) a vessel under construction that is to be or could be registered on completion; and


(b) $20 in any other case.


(2) If a surveyor -


(a) carries out a service specified in Schedule 1 outside normal public service hours; or


(b) travels in connection with a service specified in a Schedule to these regulations outside those hours,


the hourly rate in respect of so much of the service or travel as is carried out outside those hours is double that prescribed by subregulation (1).


Travelling time


5. (1) Where a surveyor travels from his normal place of employment to another place to carry out a service specified in a Schedule to these regulations there shall be charged, in addition to the fee specified for that service, a charge for the surveyor’s travelling time.


(2) The travelling time referred to in subregulation (1) shall be charged in accordance with the following Table.

Travel and subsistences expenses


6. A person for whom a surveying service specified in a Schedule to these regulations is carried out shall pay to the Marine Department a charge equal to any costs incurred by the Department in respect of the travel, victualling and accommodation of the surveyor while carrying out that service, or while travelling in connection with the service.


Inspections in respect of hulls, engines and safety equipment


7. -(1) Subject to subregulation (2), the survey fee payable in respect of an inspection of a vessel’s hull, engines or safety equipment are in respect of one visit to the vessel by a surveyor.


(2) If, on a visit by a surveyor in accordance with subregulation (1), the vessel is not ready for completion, the surveyor will issue a defects list to the vessel’s owner and will subsequently make a second visit to the vessel to ascertain whether the defects specified in the list have been corrected.


(3) A visit in accordance with subregulation (2) is free but all other visits will be charged for in accordance with Schedule 1.


Progressive surveys of machinery


8. -(1) During the construction of a vessel it shall be surveyed progressively with the hull and each unit of machinery being surveyed by way of a special survey charged for in accordance with item 6 of Schedule 1.


(2) A Certificate of Survey in respect of a vessel must not be granted in respect of any period which extends beyond the estimated date that any unit of machinery on the vessel becomes out of survey.


Tonnage measurement surveys


9. -(1) The fees specified in Schedule 2 apply in respect of a tonnage measurement survey carried out in respect of a vessel.


(2) Before a tonnage measurement survey is carried out in respect of a vessel a fee calculated at the rate of $4 for each metre of the overall length of the vessel must be paid.


(3) The fee paid under subregulation (2) shall be deducted from the fee payable on completion of the survey as calculated in accordance with Schedule 2.


(4) Where adequate ships plans are not available anytime taken in carrying out any necessary extra measurements of the vessel shall be charged for at the rate applicable to a special survey (Item 6 of Schedule 1).


Load Line surveys


10. -(1) The fees specified in Schedule 3 apply in respect of a load line survey carried out on a vessel that is not a Load Line Convention ship, and must be paid before the survey is carried out.


(2) Where adequate ships plans are not available anytime taken in carrying out any necessary extra measurements of the vessel shall be charged for at the rate applicable to a special survey (Item 6 of Schedule 1).


Inclining test


11. -(1) The fees specified in Schedule 4 apply in respect of the provisions of a surveyor to supervise an inclining test on a vessel and the provision of any Approved Stability Information in respect of the vessel.


(2) The fees specified in Schedule 4 do not cover the provision of any weights or personnel (other than the surveyor).
