MARINE (FEES) REGULATIONS, 1989


IN exercise of the powers conferred upon me by sections 98, 99, 143 and 212 of the Marine Act, 1986, I have made the following Regulations -


Short title


1. These regulations may be cited as the Marine (Fees) Regulations, 1989.


Object


2. These Regulations prescribe -


(a) the fees a candidate must pay before being admitted to an examination leading to a qualification for a certificate of competency; and


(b) certain other fees.


Regulations to be read as one


3. -(1) These Regulations are to he read as one with the Marine (Certificates of Competency and Manning of Vessels) (General) Regulations, 1989, and the other Regulations referred to in those Regulations.


(2) In particular words and phrases defined in the Marine (Certificates of Competency and Manning of Vessels) (General) Regulations, 1988 have the same meaning when used in these Regulations.


Examinations Fees


4. -(1) Subject to subregulation (3), the fee to be paid by a candidate for admission to an examination leading to a qualification for a grade of certificate of competency referred to in column 1 of the Table set out in Schedule 1 is that shown against that grade in column 2 of that Table.


(2) Subject to subregulation (3), the fee for a separate eyesight test carried out for the purpose of ascertaining a person’s admissibility to an examination leading to a qualification for a certificate of competency where the fee for that examination is paid, is $5.


(3) Where a candidate for admission to an examination leading to a qualification for a certificate of competency or to an eyesight test is not -


(a) a citizen of Fiji; or

(b) a citizen of any other country that is a member of the South Pacific Forum,


the fee for the examination or test is double that referred to in subregulation (1) or (2), as the case may be.


Refund of fees


5. -(1) Where, after payment of the prescribed fee for admission to an examination leading to a qualification for a certificate of competency, a candidate is -


(a) found not to possess the qualifications for admission to that examination as prescribed in the -


(i) Marine (Certificates of Competency (Qualifications for Entry to Examinations) (Deck Officers) Regulations, 1989;


(ii) Marine (Certificates of Competency (Qualifications for Entry to Examinations) (Engineering Officers) Regulations, 1989;


(iii) Marine (Certificates of Competency (Required Qualifications) (Ratings)) Regulations, 1989,


as the case may be; or


(b) in the case of a candidate applying for admission to an examination leading to a qualification for a certificate of competency as an officer, found to be suffering from a medical defect that would render him incapable of satisfactorily discharging the ordinary seagoing duties of a holder of a certificate of competency,


the Marine Board shall refund the fee paid by the candidate.


(2) Paragraph (l) (b) shall not apply where, by virtue of subregulation 6(7) of the Marine (Certificates of Competency (Examination Procedures)) Regulations, 1989 a candidate has been allowed to taken an examination.


Other fees


6. The fee payable in respect of a matter referred to in Column 1 of Schedule 2 is the amount specified in Column 2.
