SMALL ISLANDS NATIVE LANDS REGULATION, 1896
No. 3 of 1896

QUEEN'S REGULATION


(Made in the name and on behalf of Her Britannic Majesty by Her Majesty’s High Commissioner for the Western Pacific, in accordance with the provisions of the Pacific Order in Council, 1893.)

TO PROHIBIT THE ALIENATION OF NATIVE LAND IN SMALL ISLANDS FORMING PART OF HER MAJESTY'S DOMINIONS, OR BEING UNDER HER MAJESTY'S PROTECTION.

1. THIS Regulation shall extend to the following islands:-

Manahiki;
Rakahanga;
Tongarewa (Penrhyn);
Pukapuka and the Danger Islands; and
The islands of the Union Group.


2. From the date of the coming into force of this Regulation the alienation of native lands in the before-mentioned islands is prohibited; as is also the leasing of any such land except in the manner hereinafter provided.

3. Native land may with the sanction of the High Commissioner be leased for any term not exceeding twenty-one years. The terms of the proposed lease must be submitted to the High Commissioner for approval and shall have no validity until such approval shall have been signified in writing. In the event of the proposed tenant having entered into possession and of the approval of the High Commissioner to the proposed lease having been refused such proposed tenant shall be deemed to be holding on a tenancy determinable at any time after one month's notice.

4. It shall be lawful, without the previous consent of the High Commissioner being given, for a lease of native land to be entered into on a tenancy determinable at any time after not more than six months' notice.

5. Unless otherwise agreed the tenant of any native land may on the expiration of the tenancy remove any buildings erected by him.

6. This Regulation may be cited as the “Small Islands Native Lands Regulation, 1896.”

Published and exhibited in the public office of the High Commissioner this twenty-fourth day of August one thousand eight hundred and ninety-six.
