Census Ordinance - Census Regulations 1990

THE REPUBLIC OF KIRIBATI


CENSUS ORDINANCE
(Cap 8)


CENSUS REGULATIONS 1990


In exercise of the powers conferred by section 5 of the Census Ordinance, the Census Commissioner hereby makes the following Regulations:-


Citation and application


1. These Regulations may be cited as the Census Regulation 1990 and shall apply to the conduct of the census directed to be taken by the Census Order 1990.


Interpretation


2. In these Regulations, unless the context otherwise requires -


"dwelling" means any place whatsoever in which a person is living at the time prescribed and any place which is wholly or partly used for human habitation at such time and includes -


(a) any building, erection, tenement or part there-of used wholly or partly for human habitation;


(b) any hotel, lodging-house, boarding house or club ;


(c) any prison, police station, barracks and public or private charitable, religious, educational or other institution;


(d) any vessel within the territorial waters of Kiribati;


"occupier" means the person living in and in charge of a dwelling at the time prescribed, and includes every householder and the head of every family, living in the dwelling, and if there is no such person in charge of the dwelling any other person living in the dwelling at the time prescribed, and if the person in charge of any dwelling is a company; the manager, secretary or other officer in charge of the dwelling, and in the case of an institution the person in charge of the institution, and in the case of a vessel, the Master or other person in charge of the vessel;


"time prescribed" means midnight on the 6th of November 1990.


Appointment of supervisors, etc


3. The Census Commissioner may be writing under his hand specified in Schedule 1 to these Regulations appoint so many persons as he may deem necessary to be supervisors or enumerators within any island or part thereof for the purpose of carrying out the census therein.


Duties of Enumerator


4. Every enumerator shall comply with the instructions of the Census Commissioner and of the supervisor of his island or part thereof and shall carry out such duties as are assigned to him.


Manner of taking census.


5. The Census shall be taken by means of the completion of a Census Return in the form specified in Schedule 2 to these Regulations.


Completion of Census Returns.


6. (1) Subject to paragraph (2) every person in Kiribati shall -


(a) furnish to the best of his knowledge and belief the particulars required to enable the proper completion of a Census Return; or


(b) take all reasonable steps to ensure that such particulars are furnished on his behalf by some other person.


(2) The occupier of every dwelling shall furnish, to the best of his knowledge and belief, all the particulars required to enable the proper completion of a Census Return in respect of himself and of every person who -


(a) is actually present in the dwelling at the time prescribed;


(b) returns to or arrives in the dwelling within twelve hours after the time prescribed, such person not having been otherwise enumerated.


Enumerator to carry written appointment, etc


7. Any person acting as an enumerator under these regulations shall carry with him his written appointment as such and shall, on being demanded so to do, produce and show it to person making such demand.

I, Iete Rouatu, Census Commissioner pursuant to Regulation 3(1) of the Census Regulations 1990 hereby appoint........................ to be ....................... Such appointment is effective and valid from 6th to 30 November 1990. The said ............... may ask of any occupier of a dwelling such questions as may be necessary nor obtaining particulars required on the census return and such occupier shall to the best of his or her knowledge and ability give such information. A person required to answer any questions on the census return who refuses to answer or gives a false answer is guilty of an offence.
