PROCUREMENT CODE (AMENDMENT) ACT OF 2009.

AN ACT
to amend Sections 194 of the Procurement Code (Act) in order to set a new threshold for application of restriction of former government
employee’s engagement in procurement with the government.
ENACTED BY THE NITIJELA OF THE REPUBLIC OF THE
MARSHALL ISLANDS
Section 1. Short title.
This Act may be cited as the Procurement Code (Amendment) Act of 2009.
Section 2. Amendments.
(1) Sections 194 (5) of the of the Procurement Code (Act) is hereby amended to read as follows:
§.194. Restriction on Employment of Present and Former Employees
(5) It shall be a breach of ethical standards for any former employee, unless the former employee’s last annual salary did not exceed $30,000, to engage in selling or attempting to sell supplies, services, or construction to the Government for one year following the date employment ceased.
Section 3. Effective date.
This Act shall take effect on the date of certification in accordance with Article IV of the Constitution and Rules and Procedures
of the Nitijela.
CERTIFICATE
I hereby certify:
(1) That Nitijela Bill No.:47 was passed by the Nitijela of the Republic of the Marshall Islands on the 13th day of May, 2009; and
(2) That I am satisfied that Nitijela Bill No.:47 was passed in accordance with the relevant provisions of the Constitution of the Republic of the Marshall Islands and the Rules of Procedures of the Nitijela.
