PART IX
EMERGENCY POWERS


PRESIDENTIAL ORDER 14
ARTICLE 78


A State of Emergency having been declared under Article 77(1) of the Constitution of Nauru and, being satisfied that this Order is reasonably required to safeguard the interests of the community, by virtue of the powers vested in me under Article 78(1) of the Constitution of Nauru and notwithstanding inconsistency with any law, I MARCUS STEPHEN, President of the Republic of Nauru hereby order as follows:


  1. Notwithstanding that Presidential Order 3 dated 11 June 2010 (limiting actions to the Supreme Court) and Presidential Order 9 dated 30 June 2010 (providing for supply) which were continued in force by Presidential Order 10 dated 2 July 2010 would otherwise lapse with the lapsing of the State of Emergency declared by me on 2 July 2010, the said Orders shall continue in force.
  2. The office of Speaker remains vacant until a Speaker is elected by Parliament.
  3. Parliament remains adjourned and will not sit until directed by the President.
  4. The President, through the Clerk of Parliament, will notify Members of the time and date of the next sitting of Parliament.
  5. Each roll of electors kept under section 6 of the Electoral Act shall remain closed until the lapse of the State of Emergency declared by me on 9 July 2010 or until further order.
