EMERGENCY POWERS


PRESIDENTIAL ORDER 20
ARTICLE 78


A State of Emergency having been declared under Article 77(1) of the Constitution of Nauru and, being satisfied that this Order is reasonably required to safeguard the interests of the community, by virtue of the powers vested in me under Article 78(1) of the Constitution of Nauru and notwithstanding inconsistency with any law, I MARCUS STEPHEN, President of the Republic of Nauru, order as follows:


  1. To meet the expenditure of the Republic for the period 1 July 2010 to 31December 2010, the sum of $27,893,246 is hereby withdrawn from the Treasury Fund.
  2. The sum withdrawn under paragraph 1 is for the purpose of expenditure in accordance with the Schedule to this Order.
  3. Any sum withdrawn under this Order and not expended by the date on which this order lapses shall be returned to the Treasury Fund.
  4. The Minister responsible for finance shall as soon as practicable after the lapse of this order lay before Parliament a full account of actual expenditure of the funds withdrawn under paragraph 1.
  5. This Order supersedes Presidential Order 9, dated 30 June 2010, which provided for supply for the period 1 July 2010 to 30 September 2010, and which is hereby revoked. The amounts in the Schedule to this Order are in substitution for and not in addition to the amounts withdrawn from the Treasury Fund pursuant to that Order. The obligations provided for in paragraphs 3 and 4 of that Order shall be deemed satisfied by performance of theobligations provided for in paragraphs 3 and 4 of thisOrder.
