EMERGENCY POWERS

PRESIDENTIAL ORDER 9

ARTICLE 78

A State of Emergency having been declared under Article 77(1) of the Constitution of Nauru and, being satisfied that this order is reasonably required to safeguard the interests of the community, by virtue of the powers vested in me under Article 78(1) of the Constitution of Nauru, I MARCUS STEPHEN, President of the Republic of Nauru hereby order –

1. To meet the expenditure of the Republic for the period 1 July 2010 to 30 September 2010, the sum of $23,377,666 is hereby withdrawn from the Treasury Fund.
   
2. The sum withdrawn under paragraph 1 is for the purpose of expenditure in accordance with the Schedule to this Order.
   
3. Any sum withdrawn under this Order and not expended by the date on which this order lapses shall be returned to the Treasury Fund.
   
4. The Minister responsible for finance shall as soon as practicable after the lapse of this order lay before Parliament a full account of actual expenditure of the funds withdrawn under paragraph 1.
