Cabinet makes the following regulations under section 15 of the Business Licences Act 2011:


1 Citation


These regulations may be cited as the Business Licences Regulations 2011.


2 Commencement


These Regulations commence on 1 August 2011.


3 Definitions
In these Regulations:


‘business premises’, see regulation 4.


4 Meaning of ‘business premises’


(1) The ‘business premises’ of a business are each place from which the business operates.


(2) If, in addition to the head office or principal premises of a business, the business operates from one or more other Business Licences Regulations 2011 premises, the head office or principal premises and each of the other premises is a business premises.


Example for subregulation (2)


If a retail business operates a main store and one or more branch stores, the main store and each of the branch stores is a business premises.


(3) However, if a business operates on a mobile basis, only the head office of the business is a business premises for the mobile operations of the business.


Example for subregulation (3)


A building and construction business that undertakes building and construction activities at different building sites is taken to be operated from the head office of the business.


5 Prescribed businesses


(1) For the definition of ‘prescribed business’ in section 4 of the Act, a business of a class specified in Schedule 1 requires a business licence.


(2) A body corporate established by a Nauru Act does not belong to a class specified in Schedule 1.


6 Licence fee


For section 6(2)(a) of the Act, the licence fee for a business licence is $250 for each business premises of the licensed business.


7 Licence period


The period of a business licence is 12 months.


8 Precondition for issue of business licence


For section 7(b) of the Act, if the name of a business is required to be registered under the Business Names Act 1976, it is a precondition for the issue of a business licence for the business that the application for the licence is accompanied by evidence of registration of the business name.


9 Licence condition


For section 9(a) of the Act, it is a condition of a business licence that a copy of the licence is displayed in a prominent place at each business premises of the licensed business.


10 Prescribed form


For section 6(2)(b) of the Act, the prescribed form for an application for a business licence is set out in Schedule 2.


11 Transitional matter


(1) This regulation applies to a person:


(a) who operates a prescribed business; and


(b) who was not required to hold a licence to operate the business under the Licences Act 1922.


(2) The person may continue to operate the business without a business licence until 31 August 2011.


(3) This regulation expires on 1 September 2011.
