The Electoral Commission makes the following Regulations under sections 78 and 136(e) of the Electoral Act 2016:

1 Citation

These Regulations may be cited as the Electoral (Proxy Voting) (Amendment) Regulations 2019.

2 Commencement

These Regulations come into effect on the day they are notified in the Gazette.

3 Amendment of regulation 4

Regulation 4(2)(d) is deleted and substituted as follows:

‘(d) must not be proxy for more than 4 voters.’

4 Amendment of regulation 9

Regulation 9 is deleted and substituted:

‘9 Withdrawal of proxy voting authorisations – more than 4 proxy voting authorisation granted to proxy

(1) If more than 4 proxy voting authorisations are purportedly granted in the name of the same proxy for an election, the 4 authorisations granted earliest in time are valid and the remaining authorisations are invalid and deemed to be withdrawn.

(2) Where any purported authorisation granted under subsection (1) becomes invalid, the Electoral Commission shall inform the proxy immediately.

(3) The voter may nominate a substitute proxy by no later than 6.00pm on the day on which proxy voting closes.

5 Amendment of Schedule 1

Schedule 1 is amended in Part B:

(a) in Form 1, line 2 of the declaration by deleting and substituting:

‘I declare that I have not consented to be proxy for more than 4 voters’.

(b) in Form 3, bullet point 6 and sub bullet point 4, by deleting ‘other’ where it appears.

The text will now read:

the person is authorised to act as proxy for 4 electors.’
