NOTARIES PUBLIC (SEALS AND RECORDS) RULES 1978


IN EXERCISE of the powers conferred on me by section 57 of the Legal Practitioners Act 1973, I hereby make the following Rules –


TITLE


1. These Rules may be cited as the Notaries Public (Seals and Records) Rules 1978.


SEAL


2. A notary public shall use as his seal only a seal bearing the words "Republic of Nauru" and "Notary Public" and the forename or forenames and the surname of the notary public and no other words, letters or numbers, and having in the centre of the seal a twelve-pointed star.


RECORDS


3. (1) From the commencement of every calendar year a notary public shall maintain a register in the form set out in the Schedule to these Rules, and shall enter therein the details, as specified in that Schedule, of every notarial act done by him, and of every refusal by him to do a notarial act, during that calendar year.


(2) On or before the last day of January in every year a notary public shall deliver to the Registrar the register of the notarial acts done and the: refusals made by hire during the last preceding calendar year.


(3) The Registrar shall keep in a safe place for thirty years every register delivered to him by a notary public but shall allow the notary public and any other person having a proper interest in any entry in the register to examine it during the hours when the office of the Supreme Court is open to the public, and to make a copy of, in the case of the notary public, any entry therein and, in the case of any other person, any entry therein in which he is properly interested.


PROTESTS


4. (1) A notary public shall deliver to the Registrar a photographic copy of every protest notarised by him; he shall deliver it to him at the same time as he delivers to him under rule 3 the register in which the notarisation of the protest is recorded.


(2) The provisions of paragraph (3) of rule 3 shall apply mutatis mutandis to copies of protests delivered to the Registrar under the preceding paragraph.
