MARITIME SECURITY (PROHIBITION) REGULATIONS 2020

Cabinet makes the following Regulations under Section 36(2)(c) of the Maritime Security Act 2019:

1. Citation
   

These Regulations may be cited as the Maritime Security (Prohibition) Regulations 2020.

2. Commencement

These Regulations come into effect on the day they are notified in the Gazette.

3. Approaching or boarding ship without lawful authority
   
   • (1) A person without the prior authorisation from customs, immigration, quarantine and the consent of the Harbourmaster shall not:
     
     • (a) approach or board any ship in Nauru waters;
       
     • (b) take or cause another person to take any material onto a ship in Nauru waters; or
       
     • (c) remove or cause another person to remove any material from a ship in Nauru waters.
       
   • (2) No person shall aid or abet any person to contravene subregulation (1).
     
   • (3) A person who contravenes subregulation (1) or (2) commits an offence and upon conviction is liable to a fine not exceeding $10,000 or to a term of imprisonment not exceeding 6 months or to both.
