Amendment to RPPL 8-52, RPPL 8-53 2012

AN ACT

To amend RPPL No. 8-52 to exempt the actions authorized by the Act from the provisions of the Environmental Quality Protection Act, the Trust Territory Environmental Quality Protection Act, the Historical and Cultural Preservation Act, and from any regulations promulgated pursuant to said Acts; and for other related purposes.

PURSUANT TO THE LEGISLATIVE AUTHORITY OF THE PRESIDENT UNDER ARTICLE VIII, '14 OF THE CONSTITUTION OF THE REPUBLIC OF PALAU, THE PEOPLE OF PALAU REPRESENTED IN THE OLBIIL ERA KELULAU DO ENACT AS FOLLOWS:

Section 1. Amendment. RPPL No. 8-52 is hereby amended by adding a new Section 8 to read as set forth below, the existing Sections 8 and 9 of the Act to be appropriately renumbered:

ASection 8. Exemptions for Other Laws. Any actions taken by the President or his designee pursuant to the provisions of this Act shall be exempt specifically: from the provisions of the Environmental Quality Protection Act (Chapter 1 of Title 24 of the Palau National Code); from the provisions of the Trust Territory Environmental Quality Protection Act (Chapter 2 of Title 24 of the Palau National Code); from the provisions of the Historical and Cultural Preservation Act (Chapter 1 of Title 19 of the Palau National Code); from any and all regulations promulgated pursuant to the aforesaid Acts; and exempt generally from all other similar national or state environmental, cultural or historical preservation, or protected area laws, and from any regulations promulgated pursuant thereto.@

Section 2. Effective Date. This Act shall take effect upon the approval of the President.
