OEK Uniform Compensation Act, RPPL 7-2 2005

SEVENTH OLBIIL ERA KELULAU
RPPL No. 7-2
First Special Session, January 2005 (Intro. as Senate Bill No. 7-1, SD3, HD2, CD1, PD1)


AN ACT


To provide a uniform compensation for members of the Olbiil Era Kelulau, based on attendance at legislative sessions, to authorize and appropriate the sum of $140,000 for the inauguration of the 7th Constitutional Government, and for other related purposes.


THE PEOPLE OF PALAU REPRESENTED IN THE OLBIIL ERA KELULAU DO ENACT AS FOLLOWS:


Section 1. Short title. This Act shall be known and may be cited as the "Olbiil Era Kelulau Uniform Compensation Act."


Section 2. Legislative findings. The passage of Charter Initiative No. 5 by the people of Palau amended the Constitution to establish a uniform fee as compensation for the members of the Olbiil Era Kelulau. This Act is intended to authorize payment to the members of the Olbiil Era Kelulau in conformance with the new constitutional provision.


Section 3. Definitions.
(a) "Attend" means actual, physical presence at a day of an Official Session as certified by a presiding officer of the appropriate house of the Olbiil Era Kelulau.


(b) "Official Session" shall mean the Regular Session authorized by 3 PNC 108, a Joint Session authorized by 3 PNC 110, a Special Session authorized by 3 PNC 113, or an installation session.


Section 4. Salary authorized.
(a) Each member of the Olbiil Era Kelulau shall receive $1,000.00 in compensation for each day of an Official Session that such member attends, up to a maximum of $50,000.00 per year. Such compensation shall be retroactive to the effective date of Charter Initiative No. 5. However, in any calendar year in which a member's term ends, the maximum compensation for such a member shall be prorated, based upon an annualized maximum compensation of $50,000.00, so that such a member shall receive no more than $4,166.67 per month. This compensation shall be paid according to rules and procedures promulgated by the Olbiil Era Kelulau. Payments shall be made bi-weekly on regular government paydays, with the compensation account of each member to be reconciled by the Minister of Finance with records of the member's actual attendance at the close of each calendar quarter. A record of each member's attendance, certified by a presiding officer of the appropriate house of the Olbiil Era Kelulau, shall be delivered to the Minister of Finance within 10 days of the close of each calendar quarter, for account reconciliation.


(b) The compensation of members of the Olbiil Era Kelulau is "salary" within the meaning of that term as used in 40 PNC 1101 and is subject to wage and salary taxation. The national government shall automatically withhold from the members' compensation wage and salary tax and contributions to the Civil Service Pension Plan Trust Fund and to the Social Security Retirement Fund.


Section 5. Inauguration appropriation. The sum of $140,000.00 is hereby authorized and appropriated for fiscal year 2005 to the Office of the President to fund the inauguration of the 7th Constitutional Government n January 2005. The entire amount of funds appropriated shall come from local revenues.


Section 6. Effective date. This Act shall take effect upon its approval by the President of the Republic of Palau, or upon its becoming law without such approval.
