Supplemental Budget Authorization and Appropriation Act, RPPL 7-9 2005

SEVENTH OLBIIL ERA KELULAU


Seventh Special Session, June 2005
RPPL NO: 7-9

AN ACT


To authorize and appropriate additional sums of $1,419,500 $1,369,500 from the National Treasury in the form of supplemental budget for the general operations of the National Government of the Republic of Palau for the fiscal year ending September 30, 2005 and for related purposes.


THE PEOPLE OF PALAU REPRESENTED IN THE OLBIIL ERA KELULAU DO ENACT AS FOLLOWS:


Section 1. Short Title. This Act may be cited as "The Supplemental Budget Authorization and Appropriation Act."


Section 2. Legislative Findings. The Olbiil Era Kelulau hereby finds that it is necessary to restore the budget originally proposed under RPPL No. 7-7. The Fiscal Year 2005 Annual National Budget Authorization and Appropriation Act drastically reduced the budget of the Legislative Branch, with particular emphasis on the House of Delegates' budget. The House of Delegates has made the effort to comply and work within these new budgetary constraints,


however, after much research and deliberation the House finds that it will not be able to complete the fiscal year without a supplemental budget. The current budget has cut the House budget from $1,820,000 to $1,420,500, which has resulted in a budget cut of $400,000, or approximately 22% of the House of Delegates Budget. It is impossible for the House of Delegates to finish the current fiscal year and perform its constitutionally mandated duties with essentially a quarter of its budget cut. Without supplemental funding the House of Delegates will be forced to close operations. For these reasons, the Olbiil Era Kelulau finds it necessary to restore the legislative branch RPPL No. 7-7 budget level to $3,586,000.


Section 3. Amendments. Sections 2 and 3 of RPPL No. 7-7 is hereby amended to read as follows:


"Section 2 Executive Branch Operations. The sum of $30,819,000 is hereby authorized to be appropriated and is appropriated for expenditure and obligation for fiscal year 2005 for the purpose of covering the operational and contingent expenses of the Executive Branch. The total amount authorized to be appropriated and appropriated shall be made up of the following available revenues: The amount of $18,125,000 shall come from local revenues; the amount of $4,000,000 shall come from Compact Section 211 (a) funds; the amount of $3,720,000 shall come from the Compact Section 215 Inflation Adjustment fund derived from Compact Section 211(a); the amount of $150,000 shall come from Compact Section 211(c) funds and shall be applied to subsection (4)(1); the amount of $93,000 shall come from the Compact Section 215 Inflation Adjustment funds derived from the inflation adjustment of Compact Section 211 (c) and shall be applied to subsection (7)(c); the amount of $631,000 shall come from Compact Section 211(d) funds and shall be applied to subsection (8)(e); the amount of $1,100,000 shall come from proceeds derived from a one time only sale of the Republic's UMDA stock holdings assets; and the amount of $3,000,000 shall come from Compact Section 211(f) Trust Fund Investment Earnings. The total authorization and the total appropriation shall be allocated according to the following schedule, respectively:

The amount of $50,000, or so much thereof as necessary, shall be used to defray the cost of electrical utilities for State Water Plant Systems; $75,000 shall be used to purchase sewer pumps for Koror State.

Section 2 Total $30,819,000"


Section 3. Boards, Commissions, and Authorities. The sum of $664,000 is hereby authorized to be appropriated and is appropriated for expenditure and obligation for fiscal year 2005 for the purpose of covering the operational and contingent expenses of Boards, Commissions, and Authorities. The entire amount of the funds authorized to be appropriated and appropriated shall come from local revenues. The total authorization and the total appropriation shall be allocated according to the following schedule, respectively:

Section 4. Amendment. RPPL No. 7-7, Section 5 is hereby amended to read as follows:

The sum of $3,676,500 is hereby authorized to be appropriated and is appropriated for expenditure and obligation for fiscal year 2005 for the purpose of covering the operational and contingent expenses of the Legislative Branch. The total amount authorized to be appropriated and appropriated shall be made up of the following available

revenues: The amount of $2,676,500 shall come from local revenues; and the amount of $1,000,000 shall come from Compact Section 211(f) Trust Fund Investment Earnings. The total authorization and the total appropriation shall be allocated according to the following schedule, respectively:

(3) House of Delegates $1,820,500

(4) House Legal Counsel $178,000

(5) Joint Staff $205,000

Section 5. Effective Date. This Act shall take effect upon its approval by the President of the Republic or upon its becoming law without such approval, or as otherwise provided by law.
