Practice Direction 2 of 2005 (48 Hours Notice of Applications for Court Orders)

TONGA

Practice Direction 2/05

48 HOURS NOTICE OF APPLICATIONS FOR COURT ORDERS

Applications are often being made by Counsel either at a hearing on directions, or so late that they do not reach the Judge and/or the opposing Counsel the day prior to the hearing. This means that the opposing Counsel and the Judge have no time to consider the application in advance or to prepare for the hearing.

In future no application will be considered at a hearing unless it has been filed with the Court (and a copy served on the opposing Counsel or party, with a certificate filed with the Court) not less than 48 hours before the hearing concerned.

R M Webster MBE
Chief Justice
