MENTAL HEALTH (AMENDMENT) ACT 2014

AN ACT TO AMEND THE MENTAL HEALTH ACT 2001

BE IT ENACTED by the King and Legislative Assembly of Tonga in the Legislature of the Kingdom as follows:

1. Short Title

(1) This Act may be cited as the Mental Health (Amendment) Act 2014.

(2) In this Act, the Mental Health Act 2001, as amended, shall be referred to as the Principal Act.

2. Section 119 amended

Section 119 of the Principal Act is amended –

(a) in subsection (1) by deleting the words "medical or dental" and replacing it with the words "medical, dental, psychosocial or spiritual"; and
(b) in subsection (2) –

• (i) in the English version only, by deleting the words "medical or dental" and replacing it with the words "medical, dental, psychosocial or spiritual"; and
• (ii) in the Tongan version only, by inserting after the word "taau" the words "koe'uhi ke fai ki ai ha faito'o fakaesino, nifo, fakasosiale pe fakalaumalie".

3. Section 120 amended

Section 120(b) of the Principal Act is amended by deleting the words "police force" and replacing them with "Tonga Police".

4. Reference to Superintendent of Prison deleted

The Principal Act is amended by deleting the words "Superintendent of Prison" wherever appearing and replacing them with the words "Commissioner of Prisons".
