CIVIL AVIATION (AIRPORT PARKING CHARGE) REGULATIONS 2002

CIVIL AVIATION ACT 1990


In exercise of the powers conferred by section 7 of the Civil Aviation Act 1990, the Minister of Civil Aviation, with the consent of the Cabinet, makes the following Regulations:


1. These Regulations may be cited as the Civil Aviation (Airport Parking Charge) Regulations 2002.


2. In these Regulations, unless the context otherwise requires—


"Airport" means the Fua‘amotu International Airport;


"card" means the parking card under Regulation 4;


"charge" means a charge prescribed in the Schedule;


"officer" means an officer appointed under section 4 of the Civil Aviation Act 1990; and


"parking area" includes staff, public, taxi, VIP parking areas or any other area designated by the Minister under regulation 3. Civil Aviation (Airport Parking Charge) Regulation 3 Regulations 2002


3. (1) The Minister shall by appropriate signs designate any area at the Airport as a parking area.


(2) No person shall park a vehicle anywhere at the airport other than a parking area unless authorised by the Minister.


4.

(1). All drivers or owners of vehicles shall be issued with a parking card when they enter the parking area, and such card shall include the time and date of entry to the parking area.


(2) All drivers or owners of vehicles shall keep the card at all times whilst at the airport.


(3). All drivers or owners of vehicles shall show the card and pay the prescribed parking charge before leaving the parking area.


(4). All drivers or owners of vehicles who lose the card before payment shall pay the prescribed charge.


5. No person shall park a vehicle at the staff, taxi or VIP parking area without the written permission of the Minister.


6. The Minister may exempt in writing any classes of vehicle from paying the prescribed charges.


7. All airport parking charges collected in accordance with these Regulations shall be paid into General revenue.


8. Any driver or owner of a vehicle who knowingly fails to pay any charge imposed by or contravenes any provisions of these Regulations, commits an offence and shall be liable on conviction to a fine not exceeding $200 or imprisonment for a period not exceeding 1 month or both.
