GOVERNMENT (HIHIFO DISTRICT VILLAGES) REGULATIONS 2000

GOVERNMENT ACT (CAP. 3)


IN EXERCISE of the powers conferred on him by section 26 of the Government Act (Cap. 3) the District Officer of Hihifo District with the sanction of the Cabinet and confirmed by the signature of the Prime Minister, makes the following Regulations:


1. These Regulations may be cited as the Government (Hihifo District Villages) Regulations 2000.


2. In these Regulations—


"Hihifo District" means the island of ‘Atata and the towns of Hihifo namely, Ha‘atafu, Kanokupolu, ‘Ahau, Kolovai, Ha‘avakatolo, Fo‘ui, Masilamea, Te‘ekiu, Kala‘au and Fahefa and all the bush lands belonging thereto;


"Public place" means any public way and any building, place or vessel to which for the time being the public are entitled or permitted to have access either without condition or upon condition of making any payment;


"public way" means any road or other way lawfully used by the public.


3. These Regulations apply to all persons who reside in the Hihifo District.


4. Every pig owner in the Hihifo District shall—


(i) keep the pig or pigs in a secure enclosure or enclosures;


(ii) keep it clean to the satisfaction of the District Officer; and


(iii) ensure that the pig or pigs have sufficient food and water.


5. Any pig owner whose pig or pigs are found in any public place or public way commits an offence.


6. The owner or occupier of any cultivated land or of any enclosed land may shoot or kill any pig or pigs found trespassing on such land provided that the pig owner if known shall be notified and provided also that if the pig owner does not claim the same within one hour after the pig or pigs are killed, the carcass may be disposed of.


7. Any person who shall fail to comply with these Regulations will be subject to the penalties provided by section 26 of the Government Act (Cap. 3).
