Government Act - Niuatoputapu Villages Regulations 2000

NIUATOPUTAPU VILLAGES REGULATIONS 2000


GS 8B of 2000


GOVERNMENT ACT (CAP. 3)


IN EXERCISE of the powers conferred on him by section 26 of the Government Act (Cap. 3) the District Officer of Niuatoputapu with the sanction of the Cabinet and confirmed by the signature of the Prime Minister, makes the following Regulations:


1. These Regulations may be cited as the Niuatoputapu Villages Regulations 2000, and shall apply to all villages in Niuatoputapu and Tafahi.


PLANTING OF TAX ALLOTMENTS


2. Every person who is the holder of a tax allotment or a permit to occupy and work any tax allotment, shall in the months shown plant, as a minimum, the following crops in his allotment—


400 ‘ufilei, September to December;


100 manioke, each month January to December;


200 hopa or any siaine variety, September to November;


200 kape, March to July;


100 kumala each month, April to October;


200 ‘ufi tokamu‘a, June and July;


100 ‘ufi tokamui, August and September;


200 talo Tonga, April to July; and


200 talo Futuna or Fisi, November to March.


PIGS


3. Every pig owner in the villages in Niuatoputapu and Tafahi shall—


(i). keep the pigs in a secure enclosure or enclosures;


(ii). keep it clean to the satisfaction of the District Officer; and


(iii). ensure that the pig or pigs have sufficient food and water.


4. It shall be lawful for any pig owner to release any pig or pigs from the enclosure or enclosures provided that they should not allow any pig to stray to neighbouring farm lands or into houses or anywhere except the immediate vicinity of their enclosures.


5. The owner or occupier or any cultivated land or of any enclosed land may shoot or kill any pig found trespassing on such land provided that the owner if known shall be notified and provided also that if the owner of the animal does not claim the same within one hour after it is killed, the carcase may be disposed of.


VILLAGE FENCE

6. The "village fence" means a fence around the boundary of any village separating the village from tax allotments or bushland.


7. All persons residing in any village shall be responsible for the—


(i). weeding of a 2-metre strip of land on each side of the village fence, once in every 2 months;


(ii). maintenance and repair of the fence.


8. Climbing over the village fence, except in designated access areas, is prohibited.


9. Cutting or damaging of any fencing material which is part of the village fence is prohibited.


10. Gates in the village fence shall be closed after use by any person.


11. Any person who discovers any damage to the village fence shall immediately report it to the Town Officer.


12. Using any part of the village fence as anchor for the tether of any livestock is prohibited.


13. Any livestock found to be tethered to any part of the village fence shall be taken to the village pound, and the owner will be prosecuted.


PENALTY

14. Any person who shall infringe any provision of these Regulations shall on conviction be liable to the penalties provided by section 26 of the Government Act.


REPEAL


15. The Village Regulations relating to Niuatoputapu (Cap. 3) are hereby repealed.
