PENAL CODE (AMENDMENT) ACT 2017

AN ACT TO AMEND SECTION 26A OF THE PENAL CODE TO MAKE PROVISION FOR THE EXCLUSION OF WEEKEND DETENTION AS A FORM OF IMPRISONMENT FOR BREACH OF THE LEADERSHIP CODE AND PART X OF THE PENAL CODE.

Commencement [24th November, 2017]

1 Short Title

This Act may be cited as the Penal Code (Amendment) Act 2017.

2 Amendment to section 26A

Section 26A is amended by inserting a new subsection (6) after subsection (5) to read:

(6) A leader convicted under the provisions of the Leadership Code and to an offence under Part X- Corruption and the Abuse of Office of the Penal Code shall not be sentenced by the Court to weekend detention.

Renumber current subsection (6) to subsection (7) to give effect to the amendment.
