KAUPULE (ELECTIONS) AMENDMENT REGULATIONS
LN. 03 of 2015


MADE UNDER SECTION 16 OF THE FALEKAUPULE ACT


Commencement [14th July, 2015]


1 Citation


This Regulation may be cited as the Kaupule (Elections) Amendment Regulations.


2 Amendment to Regulation 16


Regulation 16 is repealed in its entirety and replaced with the following words:-


"The presiding officer shall cause to be placed in the polling station of which he is in charge a ballot box. When in use for voting the ballot box shall be located in front of the presiding officers and be visible to everyone else and shall be so constructed that the ballot papers can be put therein by the voter but cannot be withdrawn by him. "


3 Amendment to Regulation 17


Regulation 17 is repealed in its entirety and replaced with the following texts:-


"Immediately before the commencement of voting, the presiding officer at the polling station shall show to such polling agents or other persons who may be present thereat, the ballot box is empty and shall thereupon seal such box in such manner as to prevent it being opened without breaking the seal."


4 Amendment to Regulation 18


(1) Regulation 18(d) is repealed in its entirety and replaced with the following texts:-


"A voter on receiving a ballot paper, shall go immediately into one of the screened compartments in the polling station, and shall there secretly record his vote and shall place his ballot paper in the ballot box placed in front of presiding officers which should be visible to everyone else."


(2) Regulation 18(e) is repealed in its entirety and replaced with the following texts:-


"A voter shall not vote for more than 6 candidates nor record more than 1 vote in favour of any candidate nor place on the ballot paper any writing or mark by which he may be identified."


(3) Regulation 18(g) is repealed in its entirety and replaced with the following texts:-


"If a voter, by reason of blindness or other physical disability, is unable to cast his vote, he shall call the presiding officer aside accompanied by a police officer and tell him without the presence of another or within hearing, the names of the candidates for whom he wishes to vote and the presiding officer shall record the voter's vote and place the voter's ballot paper in the ballot box."


5 Amendment to Regulation 29


Regulation 29 is amended by repealing it in its entirety and replaced with the following texts:-


"Any ballot paper-


(a) which does not bear an official mark; or

(b) on which anything is written or marked by which a voter can be identified other than the printed number; or

(c) from which the elector's intention cannot be deduced


Shall not be counted."


6 Amendment to Regulation 31


Regulation 31 is amended by repealing it in its entirety and replaced with the following texts:-


"The returning officer or assistant returning officer, as the case may be, shall prepare a statement showing the number of ballot papers rejected under the following heads-


(a) want of official mark;

(b) writing or mark by which the voter could be identified;

(c) lack of clear intention
