PRICE CONTROL ACT 1990 (ACT 2 OF 1992)


ENACTED BY THE PARLIAMENT OF TUVALU


Commencement [Date]


IN EXERCISE of the powers conferred by section 6(1) of the Price Control Act 1990, the Price Control Board, with the approval of the Minister, make the following order —


1 Citation and commencement


This order may be cited as the Price Control Order 1992 and shall come into force on the date of publication of this order.


2 Maximum retail selling price


(1) Subject to paragraph 2 of this order the selling price maximum retail selling price of all commodities specified in the Schedule (excluding item 19) to the Price Control Act 1990 shall be determined by retailers in accordance with the following formula:


(i) Overseas Charges


(ii) F.O.B.


(iii) Freight


(iv) Insurance


(v) Total Overseas Charges .........................


(vi) Plus Local Charges .........................


(vii) Bank Charges/Documentation


(viii) Import Duty


(ix) Sales Tax


(x) Wharfage


(xi) Internal Freight and Cartage


(xii) Internal Insurance (not to exceed 1% of total overseas charges)


(xiii) Total Local Charges .........................


(xiv) Mark up not to exceed 15% .........................


(xv) Maximum Retail Selling Price .........................


(2) Where a retailer buys any commodity specified in the Schedule (excluding item 19) to the Price Control Act 1990 within Tuvalu for the purpose of resale, the retail p rice of that commodity shall not exceed 15% of its buying price.
