PUBLIC PROCUREMENT AMENDMENT REGULATIONS 2015

MADE UNDER REGULATION 7(2)(A) OF THE PUBLIC PROCUREMENT REGULATIONS 2014


Commencement [19th October, 2015]


1 Citation


This Regulation may be cited as the Public Procurement Amendment Regulations 2015.


2 Commencement


These Regulations will come into force on 19th October, 2015.


3 Amendment to Regulation 6


(1) Regulation 6(1) is amended as follows:-


(i) Remove "and" after the semicolon in Regulation 6(1)(e);

(ii) Insert "and" after the semicolon in Regulation 6(1)(f);

(iii) Insert "(g) Director of Works when the PRC is reviewing procurement of works" after Regulation 6(1)(f).


(2) Regulation 6(4)(a) is amended by repealing it in its entirety and replaced with the following words-


"(a) review and issue a letter of no objection to all major procurement bidding documents for procurement estimated to cost more than $25,000, or less than $25,000 when considered by the CPU to be technically or commercially complex, prior to calling of bids;"


4 Amendment to Regulation 11


(1) Regulation 11(2) is amended by repealing the provision in its entirety and substitute with the following words:-


"(2) Major procurement contracts shall be approved by the Procurement Review Committee through a "Letter of No Objection" prior to signature by the Secretary of the concerned Ministry;"


5 Amendment to Regulation 38


Regulation 38(3) is amended by repealing it in its entirety and substitute with the following words:-


"(3) The minimum bidding period shall be:

(a) 20 days for open shopping under regulation 23; and

(b) 35 days for open competitive bidding under regulation 24."


6 Amendment to Regulation 62


Regulation 62(2) is amended by repealing it in its entirety and substitute with the following words:-


"(2) The Secretary or Procurement Officer of the concerned ministry shall be responsible for management of contracts procured through major and minor procurement."
