IMPORT OF GOODS (CONTROL)

To authorise the Minister to control and prohibit the importation of certain goods into Vanuatu and to provide for matters in relation thereto.

INTERPRETATION

1. In this Act -

"goods" means any merchandise including animals, birds and fish, any minerals and other substances and generally articles of any description;

"Minister" means the Minister responsible for industry.

MINISTER MAY PROHIBIT OR RESTRICT IMPORTS

2. (1) For the purpose of protecting and stimulating local industry the Minister may by Order either restrict or prohibit the importation of goods into Vanuatu or specified parts thereof.
   

(2) An Order restricting or prohibiting the importation of goods may prescribe such conditions as the Minister may consider necessary therefor.

(3) An Order restricting the importation of goods may limit the importation to prescribed categories of businesses.

EXEMPTION

3. (1) There shall be exempt from any Order made under section 2 all goods which shall have been consigned for shipment to Vanuatu before the date of the coming into operation of that Order.
   

(2) In any proceedings under this Act the burden of proving that any goods are exempt from an Order shall be upon the person claiming the exemption.

OFFENCES

4. Any person who contravenes the provisions of any Order made under this Act shall be guilty of an offence.
   

Penalty: fine of VT100,000 or imprisonment for 6 months or both.

FORFEITURE

5. Where a person is convicted of an offence under this Act the court may, in addition to any other penalty imposed, order that any goods in relation to which the offence was committed be forfeited.

IMPORT OF GOODS (MISCELLANEOUS CONTROLS) REGULATIONS

To restrict the importation of miscellaneous items into the Republic of Vanuatu.

RESTRICTION AS TO THE IMPORTATION OF MISCELLANEOUS ITEMS

1. No person may import into the Republic of Vanuatu any of the goods which are described and specified under the customs tariff headings set out in Schedule 1 without an import licence issued therefor by the Minister.
   

APPLICATION FOR A LICENCE

2. An application for a licence in pursuance of these regulations shall be made in the first instance to the Minister.
   

FORM OF APPLICATION

3. An application for a licence shall be in writing and shall contain such information as the Minister may in each case require.
   

FORM OF LICENCE

4. (1) A licence issued under these regulations shall be in the form set out in Schedule 2, and subject to such conditions as may be specified in the licence.
   

(2) The Minister may add to or vary the conditions to which a licence is subject.

Under the provisions of the Import of Goods (Miscellaneous Controls) Regulations a licence is hereby granted to the person specified herein as "Owner" to import goods which, by reference to Part I of the table hereunder -

(a) conform to the description in column 3;

(b) fall within the item, sub-item, paragraph or subparagraph of Schedule 1 to the Import Duties (Consolidation) Act, Cap. 91 specified in column 1 in relation to that description; and

(c) are not in total during the period specified in paragraph (i) hereunder in excess of the quantity or value for duty, as the case may be, specified in column 2.

This licence is granted subject to compliance with -

(i) the requirement that the goods are imported for home consumption:

not earlier than the day of 19. and,

not later than the day of 19 and

(ii) such other conditions or requirements, if any, as are specified in Part II of the table.
