Price Control (Prices Advisory Committee) Regulations

PRICE CONTROL (PRICES ADVISORY
COMMITTEE) REGULATIONS


Order 2 of 1995


To provide for members of the Prices Advisory Committee and for connected purposes.


1. Definitions
In these regulations, unless the context otherwise indicates:


“committee” or “Prices Advisory Committee” means the Prices Advisory Committee established by section 6 of the Price Control Act [Cap. 86];


“Minister” means the minister for the time being responsible for price control.


2. Composition of Prices Advisory Committee
(1) The Prices Advisory Committee shall consist of a chairman and four (4) other members appointed by the Minister and shall be composed as follows –


a member who is a representative of importers;


a member who is a representative of traders;


a member who is a representative of consumers;


a member who is an officer from the Department of Economic Affairs who shall be the Vice-Chairman; and


a member who is a representative of the Ministry responsible for price control who shall be the Chairman.


The term of office for a member is three (3) years and a member is eligible for re-appointment.


A member may resign his office by giving not less than thirty (30) days notice in writing to the Minister.


The Minister may –


(a) remove a member from office by notice published in the Gazette;

(b) terminate the appointment of a member or the nomination of an alternate member who is absent from three (3) consecutive meetings of the committee without having informed the chairman prior to the meetings.

The Minister on appointing a member may nominate an alternate member to act in the place of the appointed member when the appointed member cannot perform his duties due to absence from Vanuatu or incapacity due to illness.


An alternate member when acting in the place of a member shall enjoy all the rights and privileges of the member he represents.


All appointments and nominations made under this regulation must be published in the Gazette.


3. Meetings of the Committee
(1) Meetings of the Committee will be held at such times and places as the chairman may determine from time to time provided there are not more than ten (10) meetings in each year and reasonable notice of each meeting is given to each member.


(2) The quorum of meetings of the Committee will be four (4) members including the Chairman or the Vice-Chairman.


(3) The chairman or in his absence the Vice-Chairman will preside at every meeting of the Committee.


4. Sitting allowances
(1) A member of the Committee is entitled to a sitting allowance for each day or part of a day that the Committee sits at the following rates –


(a) chairman, VT 3000; and


(b) member, VT 2000.


(2) The sitting allowances referred to in subregulation (1) will not be paid to members who do not attend the sitting.
