STATE FLAG AND ARMORIAL BEARINGS (AMENDMENT) ACT
NO. 22 OF 2013


An Act to amend the State Flag and Armorial Bearings Act [CAP 107].

Be it enacted by the President and Parliament as follows-

  1. Amendment

The State Flag and Armorial Bearings Act [CAP 107] is amended as set out in the Schedule.

  1. Commencement

This Act commences on the day on which it is published in the Gazette.

SCHEDULE

AMENDMENTS OF STATE FLAG AND ARMORIAL BEARINGS ACT [CAP 107]

  1. After section 1

Insert

“1A Application for permit

(1) A person who wishes to:

(a) sell or display for sale or have in his or her possession for sale, or make for sale; or

(b) uses in connection with any business, trade, calling or profession;

a copy of the State Flag, Presidential Standard or the Armorial Bearings, or a thing so closely resembling any of them as to lead to the belief that the thing is one of them, must apply to the Minister for a permit.

(2) An application for a permit under subsection (1) must:

(a) be in the form prescribed by the Minister; and

(b) be accompanied by a fee prescribed by the Minister.

(3) A Permit issued under this section must be renewed every year at a fee prescribed by the Minister.

1B Transitional Provision

(1) This section applies to any person who was involved in an activity prescribed in paragraph 1A(1)(a) or (b) immediately before the commencement of this Act.

(2) On or after that commencement, the person must apply for a permit in accordance with subsection 1A(2).
