Island Courts Act - Island Courts (Powers of Magistrates) Order 2003

REPUBLIC OF VANUATU


THE ISLAND COURT (POWERS OF MAGISTRATES)
ORDER No.2 OF 2003


An Order to prescribe the powers functions and duties of a Magistrate in respect of matters before an Island Court concerning pending disputes as to customary ownership and boundaries of land.


IN EXERCISE of the powers conferred by Section 2A(1) of the Island Courts Act No.10 of 1983, as amended, CAP 167, I, VINCNENT LUNABEK, Chief Justice of the Supreme Court of Vanuatu, hereby make the following Order:


NOMINATION OF MAGISTRATE TO PRESIDE IN CERTAIN LAND MATTERS


1.


(1) Magistrate Nesbeth Wilson is hereby nominated to preside over Island Courts on all land matters arising in all areas and districts of Vanuatu, Save that the Magistrate Nesbeth Wilson shall not hear any land cases concerning the Island or people of Ambae/Maewo.


(2) Magistrate Nesbeth Wilson shall undertake responsibility more specifically for the following Islands:

(a) Efate

(b) Epi and Islands of Shepherds group

(c) Pentecost


(3) Furthermore, she shall perform her powers, functions and duties pursuant to the Island Courts (Powers of Magistrates) Order No.1 of 1990 as published in the Official Gazette No.1 of 1990.


COMMENCEMENT


2. This Order shall come into force on the date of its signature.

(AS AMENDED)


WARRANT ESTABLISHING THE EPI ISLAND COURT


I, Vincent LUNABEK, Chief Justice of the Republic of Vanuatu, under and by virtue of the powers conferred upon me by Section 4 of the Island Courts Act No. 10 of 1983 (as amended),


HEREBY ESTABLISH THE EPI ISLAND COURT, effective on the date of signature hereunder, to exercise the jurisdiction conferred on it by the Island Courts Act or by any other Act but subject to the limitations:


Territorial jurisdictions


The territorial jurisdiction of Epi Island Court shall extend to the boundaries of the Epi and Laman Islands.


Limitation on jurisdiction


The jurisdiction of the Pentecost Island Court shall be limited to hearing of pending customary land claims on the Islands of EPI and LAMAN.

HEREBY ESTABLISH THE PENTECOST ISLAND COURT, effective on the date of signature hereunder, to exercise the jurisdiction conferred on it by the Island Courts Act or by any other Act but subject to the limitations:


Territorial jurisdictions


The territorial jurisdiction of Pentecost Island Court shall extend to the boundaries of the Pentecost Island.


Limitation on jurisdiction


The jurisdiction of the Pentecost Island Court shall be limited to hearing of pending customary land claims on that Island.
