DIESEL POWER STATION ACT 1965

1965 No.3


AN ACT to authorise the Minister responsible for works to enter into a contract with Maschienenfabrik Augsburg-Nurnberg Aktiengesellschaft of Augsburg in the Federal Republic of Germany Machinery Manufacturers (hereinafter called the contractor) for the sale and purchase, erection and installation of a Diesel Electric Power Station, and incidental thereto.

[Assent and commencement date: 12 April 1965]


1. Short title – This Act may be cited as the Diesel Power Station Act 1965.


2. Interpretation – In this Act, unless the context otherwise requires:

“Government” means the Government of Samoa;

“Minister” means the Minister responsible for works, transport and infrastructure.


3. Authorising entry into contract(1) The Minister is authorised, on behalf of the Government, to enter into a contract with the contractor, whereby the contractor will agree to manufacture and sell to the Government, a Diesel Electric Power Station, including 2 diesel engines, alternators, accessories and other equipment, and erect and install the same at Tanugamanono in the town of Apia, for a price not exceeding 1,736,932 German Marks, payable at Augsburg aforesaid by instalments during the years 1965 and 1966.
(2) The Minister shall lay a copy of any such contract (other than technical annexures) before the Legislative Assembly within 28 days after the date of execution of the contract if the Assembly is then in session, and if not within 28 days after the commencement of the next ensuing session.


4. Making some instalments payable under the contract statutory expenditure – Any instalments payable under any such contract during the year 1966, not exceeding a total sum of 680,932 German Marks, is charged upon and payable out of the Treasury Fund, and is statutory expenditure.


5. Authorising letter of credit and security therefor – Whereas funds have already been transferred by the Government to the Deustche Bank in Augsburg aforesaid and invested in the name of the Government in the Federal Republic of Germany, NOW the Minister is authorised to:

(a) arrange with the said Deutsche Bank to issue an irrevocable letter of credit to the contractor to cover the payment of all instalments payable under any such contract; and

(b) give to the said Deutsche Bank a lien or mortgage over such investments, to secure the reimbursement of the said Deutsche Bank for the payments it will be required to make under that letter of credit.

REVISION NOTES 2008-2012


This Act has been revised under section 5 of the Revision and Publication of Laws Act 2008.


The following general revisions have been made:

(a) Amendments have been made to up-date references to offices, officers and statutes.

(b) Insertion of the commencement date

(c) Other minor editing has been done in accordance with the lawful powers of the Attorney General.

(i) “hereby” removed
(ii) “shall be” changed to “is”

There were no amendments made to this Act since the publication of the Consolidated and Revised Statutes of Samoa 2007.


This Act has been revised in 2008, 2009, 2010, 2011 and 2012 by the Attorney General under the authority of the Revision and Publication of Laws Act 2008 and is the official version of this Act as at 31 December 2012. It is an offence to publish this Act without approval or to make any unauthorised change to an electronic version of this Act.
