An Act to amend the Public Service Act 1975

(24 February 1981

BE IT ENACTED by the Legislative Assembly of the Cook Islands in Session assembled, and by the authority of the same, as follows:

  1. Short Title

This Act may be cited as the Public Service Amendment (No. 2) Act 1980-81 and shall be read together with the deemed part of the Public Service Act 1975 (hereinafter referred to as "the principal Act").

  1. Occupational classification and grades

Sub-sections (1) and (2) of Section 24 of the principal Act are hereby repealed and the following new sub-sections inserted:

"(1) The occupational classes of the Public Service shall be as specified in the Second Schedule to this Act and for the purposes of sub-section (2) of Article 74B of the Constitution of the Cook Islands graded positions shall be those positions specified in the Second Schedule and where no position is specified then the Commissioner, in consultation with the departmental head or departmental heads whose department or departments is or are affected, shall determine the graded position and in which occupation class the position should be.
(2) The Commissioner, in consultation with the departmental head or departmental heads of any department or departments that is or are affected shall divide the graded positions into sub-grades according to his assessment of the relative levels of responsibility and skills required to be exercised by the employees within that sub-grade and shall prescribe the salary rate together with incremental steps end a maximum salary in each sub-grade".
  1. Repeal

Section 24A of the principal Act, and the Second Schedule thereto (as inserted by Section 3 of the Public Service Amendment Act 1980) are hereby repealed.

  1. New Schedule added

The principal Act is further amended by inserting a new Second Schedule as contained in the Schedule to this Act.
